Settled — Terms of Service

These Terms of Service ("Terms") govern your use of the Settled mobile application ("App") provided by Settled Health ("Settled Health," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 16 years old to use the App. By using the App, you represent that you are at least 16 years of age.

3. Medical Disclaimer

SETTLED IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The information provided by the App, including but not limited to FODMAP calculations, symptom tracking, dietary phase guidance, IBS Symptom Severity Scale (IBS-SSS) scores, and eating habits screening (SCOFF) results, is for informational and educational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition, dietary changes, or treatment. Never disregard professional medical advice or delay in seeking it because of information provided by this App.

The eating habits screening tool (SCOFF) is a validated informational screening instrument, not a clinical diagnosis. The SCOFF screening instrument is used under fair use for personal health education purposes. A positive SCOFF result indicates you should speak with a healthcare provider. It does NOT mean you have an eating disorder. If you receive a concerning result, please contact your healthcare provider or one of the following resources:

The IBS-SSS questionnaire presents symptom severity scores for your personal tracking purposes. These scores are not a clinical assessment and should be discussed with your gastroenterologist or dietitian.

If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately.

Settled Health does not recommend or endorse any specific tests, physicians, products, procedures, or other information that may be mentioned in the App.

4. Data Accuracy Disclaimer

While we strive to provide accurate FODMAP values and nutritional information, we do not guarantee the accuracy, completeness, or reliability of any data presented in the App. FODMAP values may vary based on food source, growing conditions, preparation method, portion size, and individual tolerance.

Barcode scanning and ingredient analysis identify the presence of FODMAP-containing ingredients but cannot calculate exact FODMAP gram quantities from packaged food labels.

Symptom correlations and insights are based on self-reported data and statistical patterns. They are not clinically validated and should not be used as the sole basis for dietary decisions.

Users should not rely solely on the App's calculations for making dietary decisions, particularly if they have severe food allergies, intolerances, or medical conditions.

5. Account and Subscription

5.1 Account

Your account is authenticated via Sign in with Apple. You are responsible for maintaining the security of your Apple ID and any access it provides to your Settled account. You agree to notify us immediately of any unauthorized use of your account.

5.2 Subscription Plans

Settled offers premium features through auto-renewable subscription plans:

5.3 Auto-Renewal and Cancellation

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.

Payment will be charged to your Apple ID account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

To cancel, go to your device's Settings > Apple ID > Subscriptions > Settled, and select "Cancel Subscription." You can also manage your subscription through the App Store.

After cancellation, you will continue to have access to premium features until the end of your current billing period. No refunds will be provided for partial billing periods.

5.4 Refunds

Refunds are processed by Apple in accordance with Apple's refund policies. To request a refund, visit reportaproblem.apple.com. Settled Health does not directly process payments or refunds.

5.5 Free Tier

Certain features of the App are available without a subscription. Settled Health reserves the right to modify which features are included in the free and premium tiers.

5.6 Free Trial

If a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial period at the rate disclosed at sign-up. You may cancel during the trial period to avoid charges.

6. User Data and Privacy

6.1 Data Ownership

You retain all rights to the personal data and content you submit through the App, including food logs, symptom entries, wellness data, and screening responses.

By using the App, you grant Settled Health a limited, non-exclusive license to process this data solely for the purpose of providing and improving the App's services to you.

6.2 Data Deletion

You may delete your account and all associated data at any time through the App's settings or by contacting us at support@settledhealth.app. Upon account deletion, your personal data will be permanently deleted within 30 days, except where retention is required by law.

6.3 Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We will not sell your personal health data to third parties.

In the event of a data breach affecting your personal information, we will notify you in accordance with applicable federal and state law.

The App, including its design, features, content, and code, is owned by Settled Health and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Settled Health disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Settled Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for personal injury, loss of data, loss of profits, or emotional distress, resulting from:

Settled Health's total aggregate liability for all claims arising from or related to these Terms or the App shall not exceed the greater of: (a) the amount you paid to Settled Health in the 12 months preceding the event giving rise to the claim, or (b) one hundred dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Settled Health, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@settledhealth.app and attempt to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

Any dispute arising from or relating to these Terms or your use of the App that cannot be resolved informally shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall take place in Sacramento County, California. The arbitrator's decision shall be final and binding.

12.3 Exceptions

Either party may seek injunctive relief in court for intellectual property disputes or data security breaches. Claims that qualify for small claims court (under $10,000) are also excluded from this arbitration provision.

12.4 Class Action Waiver

YOU AND SETTLED HEALTH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

If this class action waiver is found to be unenforceable, the entirety of the arbitration provision (Section 12) shall be null and void.

12.5 Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to legal@settledhealth.app within 30 days of first agreeing to these Terms. If you opt out, disputes will be resolved in the state or federal courts of California.

13. Modifications

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Termination

14.1 By You

You may delete your account at any time through the App's settings.

14.2 By Us

Settled Health may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the App in a manner that could harm other users or the service.

14.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination — including Sections 3, 4, 9, 10, 11, and 12 — shall survive.

15. General Provisions

15.1 Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Entire Agreement

These Terms, together with the Privacy Policy and any subscription terms presented at the time of purchase, constitute the entire agreement between you and Settled Health.

15.4 No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

15.5 Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, internet service failures, server outages, or government actions.
